Terms and Conditions for Mirai

1. Acceptance of Terms

By downloading, installing, or using Mirai ("the App"), you agree to be legally bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Mirai ("the Company," "we," "us"), the developer of Mirai.

2. Service Description

Mirai is an entertainment application offering a simulation experience, allowing users to interact with a virtual character within a digital environment. Though the app may simulate conversation or companionship, it does so artificially and should not be considered a substitute for real human interactions or professional advice.

3. User Requirements

To access or use our App, you must be at least 18 years of age or the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these Terms as a binding agreement.

4. Personal Use

Mirai is intended for personal use and must not be used for commercial purposes, except with our express written consent. The App may not be used for any illegal or unauthorized purpose, or engage in, encourage, or promote any activity that violates these Terms.

We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy to understand how we collect, use, and safeguard the information obtained from the users of the App.

6. In-App Purchases

Mirai may enable in-app purchases. You agree to pay all fees or charges incurred by your account, including applicable taxes. All purchases are final and non-refundable, except at our sole discretion and in accordance with the rules governing each transaction.

7. Advertising and Third-Party Content

Mirai may display advertisements and promotions from third parties, or content created by third parties. We are not responsible for the legality, accuracy, or decency of content provided by third parties.

8. User Conduct and Acceptable Use

You understand that you are solely responsible for any data, text, software, music, sound, photographs, graphics, videos, messages, or other materials ("content") that you transmit or post via Mirai, and you assume all risks associated with it, including anyone’s reliance on its quality, accuracy, or reliability. You agree not to use Mirai to:

  • a) Upload, post, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • b) Harm minors in any way.
  • c) Impersonate any person or entity, including but not limited to, an official or employee of Mirai, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • d) Manipulate identifiers to disguise the origin of any content transmitted through the Service.
  • e) Upload, post, or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.
  • f) Collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through e above.

9. Limitation of Liability and Disclaimer of Warranties

Under no circumstances will Mirai be liable to you or any third party for any indirect, consequential, incidental, special, or punitive damages, including lost profit or lost revenue, arising from your use of the App, even if we have been advised of the possibility of such damages. Mirai is provided "as is" and "as available" without any warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Continued use of the App after any such changes constitutes your acceptance of the new Terms.

11. Termination

We may terminate or suspend access to Mirai immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
